Culberson v. Clay County
The estate and heirs of Dale O'Neal, a pre-trial detainee who was murdered by his cellmate in Clay County's jail, filed a lawsuit against several officers and the county under Section 1983. In re: Chamber of Commerce
A group of business associations, including the Fort Worth Chamber of Commerce, filed a lawsuit in the Northern District of Texas against the Consumer Protection Financial Bureau (CFPB). The plaintiffs challenged a new Final Rule issued by the CFPB regarding credit card late fees and sought a preliminary injunction against the rule. The plaintiffs requested expedited briefing and review due to the imminent effect of the rule and the substantial compliance it required.The district court, instead of ruling on the motion for a preliminary injunction, considered whether venue was appropriate in the Northern District of Texas and invited the CFPB to file a motion to transfer the case. The CFPB complied, and the district court granted its motion, transferring the case to the United States District Court for the District of Columbia. The plaintiffs then petitioned for a writ of mandamus, arguing that the district court abused its discretion by transferring the case while their appeal was pending and, alternatively, lacked jurisdiction to transfer the case.The United States Court of Appeals for the Fifth Circuit agreed with the plaintiffs, stating that the district court acted without jurisdiction. The court explained that once a party properly appeals something a district court has done, in this case, the effective denial of a preliminary injunction, the district court has no jurisdiction to do anything that alters the case’s status. The court clarified that its decision was not about the correctness of the district court’s transfer order but rather about whether the court had jurisdiction to enter it. Citizens for Clean Air & Clean Water in Brazoria County v. United States Department of Transportation
In this case, a government agency had approved a license to construct and operate a massive deepwater oil facility off the coast of Texas. Career Colleges and Schools of Texas v. United States Department of Education

In an effort to curb illegal immigration, the Texas legislature passed Senate Bill 4 (S.B. 4), which amended various statutes. The new laws prohibited noncitizens from illegally entering or reentering the state and established removal procedures. However, the United States, two non-profit organizations, and the county of El Paso challenged S.B. 4, arguing that it was preempted by federal law. The district court granted a preliminary injunction, and the state of Texas appealed.The United States Court of Appeals for the Fifth Circuit denied Texas’s motion to stay the injunction, arguing that the state had not shown it was likely to succeed on the merits of its preemption claims. The court found that the federal government has broad and exclusive power over immigration, including the entry and removal of noncitizens. The court also noted that the Texas law interfered with the federal government's foreign policy objectives and could lead to unnecessary harassment of noncitizens who federal officials determine should not be removed.Furthermore, the court concluded that S.B. 4 conflicted with federal law because it blocked the federal government's discretion to decide whether to initiate criminal proceedings or civil immigration proceedings once a noncitizen is apprehended, and because it permitted state courts to impose criminal sanctions and order removal of noncitizens without the federal government's input.In light of these findings, the court ruled that the balance of equities weighed against granting a stay. The court emphasized that any time a state is prevented from enforcing statutes enacted by its representatives, it suffers a form of irreparable injury. However, the court also noted that enforcement of S.B. 4 could lead to international friction and potentially take the United States out of compliance with its treaty obligations. Inhance Technologies v. EPA
The case involves a petition by Inhance Technologies, L.L.C. against orders issued by the United States Environmental Protection Agency (EPA). Inhance, a company that has been fluorinating plastic containers since 1983, was charged by the EPA for violating a Significant New Use Rule regarding long-chain perfluoroalkyls (PFAS) due to the presence of PFAS in an insecticide stored in a container fluorinated by Inhance. PFAS are long-lasting chemicals found in various products and have been linked to several health issues. The EPA issued two orders under Section 5 of the Toxic Substances Control Act (TSCA), prohibiting Inhance from manufacturing or processing PFAS during its fluorination process. Inhance claimed that if the orders were enforced, they would shutdown their fluorination process and bankrupt the company.The United States Court of Appeals for the Fifth Circuit ruled in favor of Inhance, stating that the EPA exceeded its statutory authority by issuing the orders. The court held that Inhance's decades-old fluorination process could not be deemed a "significant new use" under Section 5 of TSCA. The court vacated the EPA's orders and noted that the EPA could regulate Inhance's fluorination process under Section 6 of TSCA, which requires a cost-benefit analysis for ongoing uses. The court's ruling was based on the interpretation of the term "new" in TSCA, the statutory framework, and the requirement for agencies to provide fair notice of their rules. R J Reynolds Tobacco v. FDA
In a case heard by the United States Court of Appeals for the Fifth Circuit, R.J. Reynolds Tobacco Company and other cigarette manufacturers and retailers challenged the Food and Drug Administration's (FDA) new warning-label requirement for cigarette packages and advertisements, citing violations of the First Amendment, the Administrative Procedure Act (APA), and the requirements of the Family Smoking Prevention and Tobacco Control Act (TCA). The district court ruled in favor of the plaintiffs based on their First Amendment claim, without addressing the remaining claims.The FDA appealed, and the appellate court reversed the district court's decision. The court held that the warnings were both factual and uncontroversial, thus qualifying for scrutiny under the standard set by the Supreme Court in Zauderer v. Office of Disciplinary Council of Supreme Court of Ohio. In that case, the Supreme Court held that the government could constitutionally require advertisers to disclose purely factual and uncontroversial information, provided the requirements are reasonably related to a substantial government interest and not unjustified or unduly burdensome.Applying the Zauderer standard, the court determined that the FDA's warnings were justified by the government's interest in promoting greater public understanding of the negative health consequences of smoking and were not unduly burdensome. Konan v. USPS
In this case before the United States Court of Appeals for the Fifth Circuit, the plaintiff, Lebene Konan, alleged that the United States Postal Service (USPS) employees intentionally withheld her mail for two years. Konan, who is African American, owned two properties in Texas that she rented out to tenants. She claimed that USPS employees, Jason Rojas and Raymond Drake, deliberately failed to deliver mail to these residences because they didn't like the idea of a black person owning those properties.Konan filed a lawsuit under the Federal Tort Claims Act (FTCA) and also alleged violations of her equal protection rights. The district court dismissed her claims due to lack of subject matter jurisdiction and failure to state a claim. Konan appealed the decision.The Appeals Court affirmed in part and reversed in part. It ruled that the district court erred in dismissing Konan's FTCA claim, finding that the postal-matter exception to the FTCA's immunity waiver did not apply to intentional acts such as those alleged. The court ruled that Konan's claims did not constitute a "loss," "miscarriage," or "negligent transmission" of mail, which are covered by the exception, as they involved intentional non-delivery of mail.However, the court agreed with the district court's dismissal of Konan's equal protection claims. The court held that Konan did not provide sufficient facts to support her assertion that the USPS employees continued to deliver mail to similarly situated white property owners while denying her mail delivery. It also held that her claims were barred by the intracorporate-conspiracy doctrine, which precludes conspiracy claims against multiple defendants employed by the same governmental entity. Therefore, the court affirmed the dismissal of Konan's equal protection claims.

Deanda v. Becerra
The United States Court of Appeals for the Fifth Circuit reviewed a case involving the question of whether the federal Title X program preempts a Texas law that gives parents the right to consent to their teenagers’ obtaining contraceptives. Alexander Deanda, a father raising his children according to Christian beliefs, challenged the Secretary of Health and Human Services' administration of Title X, which funds clinics providing contraceptives to minors without parental notification or consent. Deanda contested this on the grounds that it nullifies his right to consent to his children's medical care, infringing on his state-created right. The court held that Title X does not preempt Texas's law. The statute does not preempt Deanda's parental right to consent to his children's obtaining contraceptives because Title X's goal (encouraging family participation in teens’ receiving family planning services) is not undermined by Texas's goal (empowering parents to consent to their teen’s receiving contraceptives). Instead, the two laws reinforce each other. The court affirmed the district court’s judgment to the extent it declared that Title X does not preempt Texas's parental consent law. However, the court reversed the partial vacatur of a regulation which forbids Title X grantees from notifying parents or obtaining their consent, as the regulation was not challenged by Deanda under the Administrative Procedure Act or otherwise.

Espinal v. City of Houston
Maximo Espinal, a security guard, was arrested by Houston police officers for aggravated assault. Although a grand jury initially indicted Espinal, the charges were subsequently dropped. Espinal then sued the officers involved and the City of Houston, claiming he had been subjected to false arrest, malicious prosecution, and assault. The district court dismissed all of Espinal's claims based on the officers' qualified immunity and immunity under Texas law.Espinal's arrest occurred after he had a heated interaction with a plainclothes police officer, M.T. Long, who was trespassing on the property Espinal was guarding. After Espinal instructed Officer Long to leave, the officer returned with multiple police vehicles and arrested Espinal. Espinal alleged that the officers made no effort to view or collect video surveillance evidence that he said would prove his innocence.The United States Court of Appeals for the Fifth Circuit affirmed the lower court's decision. The court ruled that the officers had probable cause for Espinal's arrest. Furthermore, the court found that even if the officers had lacked probable cause, the grand jury's subsequent indictment of Espinal shielded them from liability under the independent intermediary doctrine. The court also rejected Espinal's claim that he had been maliciously prosecuted, finding that Espinal failed to allege that the officers had misled the grand jury.
