After defendant was was convicted of multiple murders and his habeas petition was denied by the district court, he filed a Federal Rule of Civil Procedure 60(b)(6) motion for relief from judgment ten years later. The Fifth Circuit found no error in the district court's determination that the Rule 60(b)(6) motion was a second or successive habeas petition, and held that defendant failed to meet the standard for a second or successive petition.
