The Fifth Circuit dismissed a petition for review of an FTC order based on lack of jurisdiction. The court held that the FTC's order denying the Board's motion to dismiss and granting the FTC's motion for partial summary decision was not a cease and desist order and thus the Federal Trade Commission Act did not expressly authorize the court to exercise jurisdiction in this case.
