The Fifth Circuit affirmed defendant's sentence after he was convicted of distributing a visual depiction of a minor engaged in sexually explicit conduct. The court held that the district court did not err in determining that his Texas deferred adjudications qualified as prior convictions for the purpose of 18 U.S.C. 2252(b)(1)'s sentencing enhancement. Furthermore, defendant's due process rights were not violated and his argument that his sentence exceeded the statutory maximum term of imprisonment was foreclosed by precedent.
