United States v. Castillo

Defendant-appellant Armelinda Castillo was employed by Westex Federal Credit Union in Lubbock, Texas. From April 2009 to April 2012, she embezzled cash from the credit union's vault. Castillo pleaded guilty to misapplication of bank funds in excess of $1,000 by a bank employee. On appeal, Castillo challenged only her sentence, arguing that the district court erred in failing to reduce her offense level for acceptance of responsibility pursuant to U.S.S.G. 3E1.1(b). Upon review, the Fifth Circuit vacated her sentence and remanded the case to allow the district court to determine in the first instance whether her challenge to the amount of funds stolen was made in good faith.
