United States v. Austin

by
Defendant plead guilty to numerous gun and drug charges without a plea agreement and was sentenced to 300 months in prison. On appeal, defendant challenged the district court's denial of his request for appointed counsel under the Criminal Justice Act (CJA), 18 U.S.C. 3006A(c), and the district court's denial of a motion to withdraw by his retained attorney. The court affirmed the judgment, concluding that the district court was not required to make a financial inquiry under the CJA regarding his financial eligibility for appointed counsel, and the district court did not abuse its discretion in finding good cause did not exist for appointment of new counsel.
