Defendant pleaded guilty to one count of conspiring to harbor an alien and subsequently challenged his sentence. The court applied a four-level enhancement for brandishing a weapon under U.S.S.G. 2L1.1(b)(5)(B) and sentenced him to 108 months in prison. The court concluded that, in light of the record as a whole, the district court's finding that defendant displayed the weapon with intent to intimidate is plausible and there was no clear factual error.
